Terms of Service

The terms for using Bloom Agents, a managed AI voice and text platform operated by BrianBloom AI.

Effective date: September 25, 2026

1. Agreement and eligibility

These Terms of Service ("Terms") are an agreement between you and BrianBloom AI, operator of Bloom Agents ("Bloom Agents," "we," "us," or "our"). By accessing or using the website, portal, managed agents, or related services, you agree to these Terms and our Privacy Policy.

You must be legally able to enter a binding agreement. If you use Bloom Agents for an organization, you represent that you are authorized to bind that organization. There is no public self-service registration; accounts and agents are provisioned by Bloom staff.

2. Managed services

Bloom Agents designs, configures, deploys, monitors, and maintains AI voice and text agents according to an agreed order, proposal, plan, or statement of work. Features, usage limits, support, integrations, pricing, and deployment timing may vary by client agreement.

Clients control approved business information and workflows through the portal. Bloom staff controls production prompts, provider credentials, telephony configuration, routing, deployment, security, and infrastructure. Provider credentials and production system instructions are not made available to clients or end users.

3. Client responsibilities

You agree to:

  • provide accurate, lawful, and current business information, notices, routing rules, and workflow instructions;
  • maintain authorized users, protect account access, and promptly report suspected unauthorized activity;
  • obtain all permissions and consents required for calls, recordings, texts, marketing, data uploads, and connected accounts;
  • review and approve agent behavior before production use and monitor consequential workflows;
  • use the services only for lawful business purposes and comply with applicable privacy, consumer-protection, telemarketing, recording, and communications laws; and
  • honor opt-outs, do-not-call requests, and recipient communication preferences.

4. Voice, SMS, MMS, and A2P requirements

Messaging through Bloom Agents may be subject to Application-to-Person (A2P) registration, carrier rules, the Telephone Consumer Protection Act, and other laws or industry standards. Registration or carrier approval does not replace your obligation to obtain legally sufficient recipient consent or make required disclosures.

Our messaging program may include consultation and onboarding follow-up, appointments, account and support updates, security alerts, client-deployed agent conversations, and separately authorized marketing. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of purchase. Reply STOP to opt out and HELP for assistance, or contact support@brianbloomai.com. Carriers are not liable for delayed or undelivered messages.

Clients may not use Bloom Agents to send unlawful, deceptive, harassing, unsolicited, or prohibited content; evade carrier filtering; use purchased consent; or send messages outside an approved use case. Each client is responsible for maintaining evidence of consent for its own recipients. We may block traffic, suspend messaging, or require remediation when necessary to protect recipients, carriers, providers, or the platform.

5. Acceptable use

You may not use Bloom Agents to:

  • break the law, infringe rights, impersonate another person, deceive recipients, or facilitate fraud;
  • send spam, malware, prohibited content, or communications without required consent;
  • collect or expose credentials, payment-card data, government identifiers, health information, or other sensitive information unless expressly approved and properly safeguarded;
  • probe, disrupt, reverse engineer, bypass, or gain unauthorized access to the platform or another client’s data; or
  • use AI output as a substitute for licensed legal, medical, financial, emergency, or other professional judgment.

6. AI limitations and human oversight

AI systems can misunderstand requests, produce inaccurate information, or take an unintended action. We do not guarantee that every response, transcription, summary, appointment, transfer, or automated action will be error-free. Clients must define escalation rules and provide appropriate human oversight. Bloom Agents is not an emergency service and must not be relied on for emergency dispatch or life-safety decisions unless expressly agreed in writing.

7. Third-party services

Bloom Agents may use or connect to telecommunications carriers, AI providers, email and calendar platforms, CRMs, payment processors, hosting providers, and other third-party services. Their terms, availability, rate limits, policies, and outages may affect the service. You authorize the access needed for integrations you approve and are responsible for maintaining your rights to connected accounts and data.

Where Bloom Agents connects to a client's Google account, our collection, use, storage, sharing, retention, and deletion of Google user data is described in the "Google user data" section of our Privacy Policy, which includes our commitment to the Google API Services User Data Policy and its Limited Use requirements.

8. Fees, billing, and taxes

Fees, included usage, overages, setup charges, payment timing, and cancellation terms are set out in your applicable order or plan. Unless that agreement states otherwise, amounts are due when invoiced and exclude applicable taxes. Usage charges may include provider pass-through costs. Failure to pay may result in restricted or suspended service.

9. Ownership and confidentiality

You retain ownership of your business content and data. You grant us the rights necessary to process that content and operate the services. BrianBloom AI retains ownership of Bloom Agents, software, infrastructure, system instructions, templates, methods, improvements, and other platform technology. Each party will protect the other party’s confidential information and use it only for the relationship, subject to lawful disclosure requirements.

10. Suspension and termination

We may limit or suspend access to protect security, prevent harm, comply with law or provider requirements, address nonpayment, or stop a material violation. Either party may terminate as allowed by the applicable order or written agreement. On termination, access and active workflows may stop, and data will be retained or deleted under our legal obligations, retention practices, and contractual commitments.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability, carrier delivery, business outcomes, or error-free AI output.

To the fullest extent permitted by law, BrianBloom AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, goodwill, or business opportunity. Our aggregate liability arising from the services will not exceed the amount you paid to us for the affected services during the three months before the event giving rise to the claim. These limits do not apply where prohibited by law.

12. Indemnification

To the extent permitted by law, you will defend and indemnify BrianBloom AI from third-party claims arising from your content, instructions, recipient lists, lack of required consent, unlawful use, connected accounts, or violation of these Terms or applicable law.

13. Changes and contact

We may update these Terms as our services or legal obligations change. Material changes will be posted with a revised effective date. Continued use after an update takes effect constitutes acceptance where permitted by law. A signed order or negotiated agreement controls if it expressly conflicts with these Terms.

Questions about these Terms may be sent to BrianBloom AI at support@brianbloomai.com.
